When is a Legionella control plan mandatory?

A Legionella management plan is a legal obligation in many situations. This is based on the Drinking Water Decree and the Legionella Prevention Regulations. This legislation applies to both priority and non-priority installations, with responsibility always lying with the owner or manager of the building.
Priority locations are obliged to have a risk analysis and management plan. These include healthcare institutions, hospitals, hotels, swimming pools, saunas, campsites and other facilities where people are at increased risk. In these locations, not only must a management plan be in place, but mandatory management measures and sampling must also be carried out.
Non-priority installations fall under the duty of care. This means that there is no mandatory sampling, but an owner must be able to demonstrate that the installation is safely managed and poses no unnecessary risks. A management plan is therefore highly recommended, especially for larger buildings, collective systems or installations with infrequent use.
A Legionella management plan is also mandatory when an installation is modified or expanded. After renovations, refurbishments or the addition of new taps, the risk analysis must be reviewed and updated.
In summary: a Legionella management plan is mandatory for all priority locations and necessary for any installation where water safety is not self-evident. Furthermore, an up-to-date plan helps to mitigate risks, provide accountability and comply with legal requirements.
